The organiser of the "STIHL fan since" campaign (referred to as "campaign" in the following), which includes the campaign page www.history.stihl.com, is ANDREAS STIHL AG & Co. KG, 71336 Waiblingen, Germany (referred to as "STIHL" in the following). The campaign will run until cancelled. The organiser reserves the right to cancel the campaign without stating any reason or being subject to any requirement to explain such action to the users.
How can I take part?
Users have the opportunity to upload pictures of themselves and a STIHL product on the website www.history.stihl.com. An upload form is used to do this. Participation is free of charge and independent of any purchase of goods or services.
The pictures submitted will be published by STIHL with a time delay. Users will receive an e-mail as soon as their picture can be viewed in the gallery.
Users have no claim with regard to the publishing of their picture.
The organiser has the right to send an e-mail to the user in connection with the picture.
Who can participate?
Users must be natural persons who are at least 18 years of age, live or have a permanent residence in the Federal Republic of Germany and be of age in the place where they are participating from.
What must be observed when choosing a picture?
Only photos in which the persons pictured are using the tools in accordance with the conditions of use and all users are wearing the recommended protective clothing will be accepted. STIHL has the right to delete or provide a comment on pictures that do not fulfil these requirements. Pictures of tools made by other companies are not permitted. Pictures in which children or animals are shown in direct proximity to the tools are also not permitted. Users bear sole responsibility for the content of the pictures they have uploaded. STIHL has no obligation to check the correctness of the applications photographed or point out any possible errors to the user.
Entries whose content is racist or sexist, which carry any political opinion, threaten, offend or insult others or glorify violence, display violations of the law, advertising, offers of services or other commercial content or pictures that show the unsafe use of the tools or the improper or dangerous use thereof will not be published.
In addition, STIHL reserves the right not to publish pictures that have no relevance to the "STIHL fan since" campaign in relation to the STIHL company anniversary.
Rights and Licences
With regard to all pictures uploaded as part of the "STIHL fan since" campaign, the user transfers to ANDREAS STIHL AG & Co. KG, 71336 Waiblingen, Germany the right, unlimited in terms of time and place, but which can be withdrawn at any time with effect for the future, to duplicate, distribute, display, make accessible to the public and reproduce the picture, as well as the right to edit said picture.
These rights apply to all business purposes of ANDREAS STIHL AG & Co. KG, even those outside the campaign, but only for use in social media and on the internet. For these purposes, the organiser may issue sublicences, e.g. to agencies. The user is aware that when a picture is used on the internet, third parties cannot be prevented from copying the picture and using it for their own ends. A message for withdrawing the right of use should be sent to the following address: email@example.com. The withdrawal can only come into effect if it contains the name of the campaign, the name of the user and an exact description of the picture.
The organiser will accept this transfer.
Users will continue to allow the organiser to use their names in the campaign.
Users will guarantee that they are authorised to transfer the above-mentioned rights to STIHL. Users will also guarantee that they have the required consent from the persons depicted in the photograph and that the pictures do not violate the rights of any third parties in any other way.
Users will indemnify the organiser against any and all third-party claims that said parties may assert against the organiser in terms of their rights being violated by the picture.
Users will receive neither remuneration nor profit from their participation. Participation is voluntary.
